ENTERPRISE ARE PAYING INTERNATIONAL INSURANCE – SHEET INSURANCE WITH LOWER LEVEL

This is notable content in Decree No. 58/2020/ND-CP issued by the Government on May 27, 2020, and took effect from July 15, 2020.

Currently, every month, the employer has to contribute to the Labor Accident and Occupational Disease Insurance Fund at the rate of 0.5% of the salary fund as a basis for paying social insurance premiums for employees.
However, in the coming time, the employer will be proposed to reduce the contribution rate to 0.3% of the salary fund as a basis for paying social insurance if the prescribed conditions are met.

– According to Clause 1, Article 4 of Decree 58/2020/ND-CP, stipulating the level of contribution to the Insurance Fund for occupational accidents and diseases.

" The employer must pay monthly social insurance premiums on the salary fund for employees specified at Points a, b, c, d, đ and h, Clause 1, Article 2, and Clause 2, Article 2 of the Law on Insurance. Society, except where the employee is a domestic worker, according to one of the following levels:
a) The normal contribution rate is equal to 0.5% of the salary fund as the basis for payment of social insurance premiums and applies to employees who are cadres, civil servants, public employees, and members of the armed forces of the People's Republic of China. Agencies of the Party, State, socio-political organizations, army, police, public non-business units using the state budget;
b) The payment level equal to 0.3% of the salary fund as the basis for social insurance payment shall be applied to enterprises that satisfy the conditions specified in Article 5 of this Decree.”

– According to Article 5 of Decree 58/2020/ND-CP, specifying the cases in which the premium rate is lower than the normal level of payment to the Occupational Accident and Disease Insurance Fund:

" Enterprises operating in industries with a high risk of occupational accidents and diseases are entitled to the payment of 0.3% of the salary fund as a basis for payment of social insurance if the following conditions are satisfied:
Within 03 years up to the time of the proposal, he/she has not been sanctioned for administrative violations in the form of fines, has not been examined for penal liability for violations of the law on occupational safety and health and insurance;
To make periodical reports on occupational accidents and reports on occupational safety and health accurately, completely, and on time within 03 consecutive years before the proposed year;
The frequency of occupational accidents of the year immediately preceding the proposed year must be reduced by 15% or more compared to the average frequency of occupational accidents of the three preceding years before the proposed year, or there shall be no occupational accident in the calculation. From 03 consecutive years before the proposed year.”
