Quyết định 22/2020/QĐ-TTg vừa được Thủ tướng Chính phủ ban hành ngày 10/8/2020 về việc giảm tiền thuê đất của năm 2020 với các đối tượng bị ảnh hưởng bởi dịch Covid-19.

Căn cứ Nghị quyết số 84/NQ-CP ngày 29/5/2020, người thuê đất gồm doanh nghiệp, tổ chức, hộ gia đình, cá nhân đang được Nhà nước cho thuê đất phải ngừng sản xuất kinh doanh từ 15 ngày trở lên do ảnh hưởng của dịch Covid-19 được giảm 15% tiền thuê đất phải nộp của năm 2020.
Doanh nghiệp, tổ chức, hộ gia đình, cá nhân đang được Nhà nước cho thuê đất trực tiếp theo Quyết định hoặc Hợp đồng của cơ quan nhà nước có thẩm quyền dưới hình thức trả tiền thuê đất hàng năm phải ngừng sản xuất kinh doanh từ 15 ngày trở lên do ảnh hưởng của dịch Covid-19.
Quy định này áp dụng cho cả trường hợp người thuê đất có nhiều hoạt động sản xuất kinh doanh khác nhau nhưng chỉ ngừng một hoạt động sản xuất kinh doanh tại khu đất, thửa đất đang được Nhà nước cho thuê đất trực tiếp.
Quyết định cũng hướng dẫn chi tiết hồ sơ giảm tiền thuê đất tại Điều 4 theo Quyết định này. Theo đó, người thuê đất có nghĩa vụ nộp hồ sơ giảm tiền thuê đất từ ngày 10/08/2020 đến ngày 31/12/2020. Hồ sơ giảm tiền thuê đất gồm có:
• Giấy đề nghị giảm tiền thuê đất năm 2020 ban hành kèm Quyết định này và
• Quyết định cho thuê đất hoặc Hợp đồng thuê đất của cơ quan Nhà nước có thẩm quyền (bản sao).
Thủ tục giảm tiền thuê đất được thực hiện theo các bước sau:
Bước 1: Người thuê đất nộp 01 bộ hồ sơ đề nghị giảm tiền thuê đất cho cơ quan thuế từ ngày 12/8/2020 đến hết ngày 31/12/2020. Nếu nộp sau thời gian này thì không được giảm tiền thuê đất.
Bước 2: Không quá 20 ngày kể từ ngày nhận đủ hồ sơ hợp lệ, cơ quan có thẩm quyền xác định số tiền thuê đất được giảm và ban hành Quyết định giảm tiền thuê đất.
Nếu sau đó thanh tra, kiểm tra người thuê đất không thuộc trường hợp được giảm tiền thuê đất thì phải hoàn trả ngân sách Nhà nước số tiền đã được giảm và tiền chậm nộp tính trên số tiền được giảm.
Nếu đã nộp tiền thuê đất của năm 2020 trước khi nhận được quyết định giảm tiền thuê đất thì được trừ số tiền đã nộp thừa vào tiền thuê đất của kỳ sau hoặc năm tiếp theo.
Hồ sơ nộp sau ngày này (từ ngày 01/01/2021 về sau) sẽ không được chấp nhận.
Quyết định này có hiệu lực từ ngày 12/8/2020.
