QUẢN LÝ THUẾ ĐỐI VỚI THƯƠNG MẠI ĐIỆN TỬ
Theo Luật Quản lý Thuế số 38/2019/QH14 đã có quy định chặt chẽ hơn liên quan đến quản lý thuế đối với hoạt động thương mại điện tử (TMĐT) như: Đối với hoạt động kinh doanh TMĐT, kinh doanh dựa trên nền tảng số và các dịch vụ khác được thực hiện bởi nhà cung cấp ở nước ngoài không có cơ sở thường trú tại Việt Nam thì nhà cung cấp ở nước ngoài có nghĩa vụ trực tiếp hoặc ủy quyền thực hiện đăng ký thuế, khai thuế, nộp thuế tại Việt Nam.
Một số công việc cần triển khai thực hiện, cụ thể:
– Để quản lý việc thu thuế đối với hoạt động kinh doanh TMĐT, cần có giải pháp về công nghệ thông tin một cách tổng thể, phù hợp với đối tượng quản lý mới, phức tạp và đặc thù của loại hình kinh doanh TMĐT. Ngoài việc tiếp tục phát triển ứng dụng theo các công nghệ truyền thống như trước kia, cần nghiên cứu đưa những thành tựu tiên tiến, vượt trội của thế hệ thống công nghệ 4.0 đang là xu thế phát triển lớn mạnh trên thế giới vào hỗ trợ công tác quản lý thuế, nhất là trong các nghiệp vụ phát hiện, cảnh báo, giám sát và đôn đốc đối tượng nộp thuế kinh doanh trong lĩnh vực TMĐT.
– Mở rộng khái niệm, định nghĩa chính sách thuế (cơ sở thường trú) theo Luật và Hiệp định mới để bổ sung đối tượng kinh doanh thương mại xuyên biên giới vào diện chịu thuế.
– Cần có sự kết hợp chặt chẽ của các Bộ, ngành khác để có được thông tin đầy đủ trong việc quản lý đối tượng kinh doanh TMĐT và quản lý khai báo, thu, nộp thuế.
– Bộ Tài chính (Tổng cục Thuế) sẽ xây dựng quy trình đăng ký thuế đơn giản (mở trên website của Tổng cục Thuế hệ thống ứng dụng để hướng dẫn tổ chức, cá nhân nước ngoài có hoạt động kinh doanh trên mạng phát sinh thu nhập tại Việt Nam được thực hiện đăng ký thuế để được cấp mã số thuế và kê khai, nộp thuế qua mạng).
